Summary:

This year, Ivano-Frankivsk city council again holds the first position in the publicity rating of local self-government bodies. The City Mayor Publicity Index dropped down to 68% (in 2013, the index was 74%), as well as did the index of executive bodies – 77% (80% in 2013). Instead, the Publicity Index of deputies increased up to 55% (50 % in 2013).

Despite the general decrease in publicity index of the City Mayor and the executive bodies, in the All-Ukrainian publicity rating these objects of measurement hold top positions. Due to publicity increase of the city council deputies, the deputy corps of Ivano-Frankivsk city council shares top rating position with Vinnytsia deputies. A compound result for the publicity level of a local self-government body can be characterized as satisfactory. Publicity Index is 67 % (61-80 % – satisfactory publicity level).

Some positive practices include free and convenient access to normative acts of a local self-government body through the electronic database of normative acts. With the help of the electronic database citizens have access to all resolutions adopted by the city council and the executive committee, and also to all implementing orders by the City Mayor. It shall be noted that during this year the electronic database of normative acts has increased. Last year it contained normative acts adopted by Ivano-Frankivsk city council since 2010. This year, though, the time span of the documents available in the electronic database went further to 2008. Moreover, as compared to the previous year, implementing orders by the City Mayor on appointing personnel are publicized in a separate section on the executive committee website that covers human resources policy of the City Mayor.

Citizens have free access to all facilities of the city council building. Also, Ivano-Frankivsk citizens may freely attend city council sessions, meetings of executive committee, and the deputy commissions. Performance of the City Mayor, executive bodies, and the deputy corps of the city council are regularly covered on the websites of the executive committee and the city council. Citizens can learn more about the procedures of public engagement into decision making process in the Statute of Local Community posted on the executive committee website.

Internet receiving room allows to send an online appeal or request for public information and trace the stage of processing. The start of the procedure of making appointments of citizens with the managers of executive committee of the city council is announced on the executive committee website. Moreover, as compared to the previous year, the executive committee website contains detailed information on the application procedures to get an appointment (last year they only offered the schedule for appointments).

Certain progress is made in publicizing declarations on property and income of the managerial officials of the city council and executive bodies. As compared to the previous year, the executive committee website has freely available both declarations of the City Mayor and the deputy mayors, and declarations of the council secretary and heads of executive bodies.

Some drawbacks in the performance of a local self-government body include complicated access to updated information on the city budget. This drawback was identified during last year measurement, this year it has not been corrected by the city authorities. The official website has a resolution ‘On City Budget for 2014’ with all relevant appendices but this information is outdated as it does not reflect any amendments introduced to the city budget in the current year.

The procedure of making appointments with the authorities of the city council executive committee does not provide for any distance forms for applying. As compared to the previous year, there has been no progress in establishing clear and unified procedure of reporting of the City Mayor and the deputies to the community. Therefore, it allows deputies choosing reporting format independently or avoid reporting at public meetings.

Despite the opportunity to freely attend deputy commissions meetings, it is very complicated for a citizen to execute this right in practice. Citizens can only learn about time and place of meetings in the city council building, as the website does not contain any such information. That is why citizens are not able to realize their right to attend the commissions meetings without restrictions as they do not have available any information on time and place of the deputy commissions meetings.

The drawbacks also include lack of electronic voting system which makes it impossible for citizens to trace individual voting results by the deputies. Also, citizens have no free access to information on registration of deputies at the council session, or to minutes of the council sessions, or deputy commissions meetings. It makes it impossible for citizens to freely trace activity of their elects, their attendance of session and meetings of deputy commissions, as well as to assess their effectiveness. In addition to that, we have detected certain regress in providing access of citizens to information on the use of money from deputy funds. As compared to the previous year, this year they have not publicized the report on the use of City Council Fund resources for the execution of deputy mandate.

Official website of Ivano-Frankivsk executive committee allows citizens getting acquainted with biographical data on the City Mayor and his declaration of property, revenues, expenditures, and financial liabilities. With the help of a reference book for citizens posted on the official website, citizens can obtain information on location, mailing address, and communication means numbers of the City Mayor. Internet receiving office offers a convenient opportunity to address a City Mayor online. The activities of the City Mayor are regularly publicized on the executive committee official website.

As to citizen visits, as compared to the previous year, the official website of Ivano-Frankivsk city council executive committee offers an opportunity for citizens to find the receiving hours to meet the mayor, and also the procedure of applying for an appointment. Provisions on the procedures for verbal meetings on personal issues at Ivano-Frankivsk city council executive committee are available in the section of ‘Meetings With Citizens’.

In comparison to last year measurement, nothing has changed as to information on the powers of the City Mayor available on the executive committee official website. A special section on the website dedicated to these issues only refers to the fact that the powers of the City Mayor are determined by the Law of Ukraine ‘On Local Self-Government in Ukraine’. The website does not have available any detailed list of City Mayor’s powers that would be easy to understand for citizens. The ways of informing citizens on City Mayor’s powers by referring to the legal act with the respective information cannot be treated as such that provides for convenient access to information.

 

Recommendations:

Due to lack of progress, as compared to the previous year, in the sphere of providing easy access of citizens to information on City Mayor’s powers, and also with regard to the fact that citizens hardly understand any areas of responsibility of different local self-government bodies, it is recommended that the official city website publish an exhaustive list of powers of Ivano-Frankivsk city head in the section on powers of the City Mayor.

Information On the City Mayor Units and HR Policy?80%

The website of Ivano-Frankivsk city council executive committee only contains information on full-time advisors to the City Mayor (department of executive support service of city council) with the indication of areas of responsibility and contact details. Information on part-time advisors and consultants is not available on the website. The common contact details of city council officials and the units within its administration can be found by Ivano-Frankivsk citizens in the section ‘For Citizens’ on the executive committee official website.

As to access to information on appointment to positions and holding competitions for vacancies, as compared to the previous year, there have been some positive changes. Resolutions by the City Mayor on appointments to positions, lists of available vacancies, announcements on holding competitions for vacancies are available in the ‘Vacancies’ section on the city executive committee website. It allows citizens to get acquainted with the information on personnel appointments by the city mayor in an online mode.

There have not been any changes only as to providing unrestricted access to the minutes of competition commission. The same as before, they are only available through written requests for public information.

Recommendations:

To provide free access of citizens to minutes of competition commission meetings on the results of competitions for vacancies by publishing them on Ivano-Frankivsk official website. It would allow not only to facilitate access to information but also help more effectively implement transparency principle into the City Mayor’s policy.

Basic Strategic (Conceptual) Documents of Municipality?66%

Strategy for raising competitiveness and economic development of the city of Ivano-Frankivsk for 2011-2015 can be found via a convenient search system in the electronic database of Ivano-Frankivsk city council regulatory acts.

The ‘City Programmes’ section on the executive committee website offers free access to short-term and mid-term programmes of economic and social development of the city.

As to access of citizens to current information on the city budget, as compared to the previous year, there have been no changes. The official website separate section includes city council resolution ‘On City Budget for 2014’ with amendments. However, the figures in amendments are not relevant as they do not reflect changes to the budget over the current year. In order to receive relevant information on the budget, one needs to see the resolutions by the city council that made amendments to the budget. Section on the ‘City Budget’ does not have those resolutions. They can only be found in the general electronic database of regulatory acts of Ivano-Frankivsk city council. Therefore, citizens who are not fully aware of the budget process could not freely get acquainted with the current city budget.

Quality management system (ISO) is introduced in Ivano-Frankivsk. According to the results of recent certification audit, Ivano-Frankivsk city council received in 2012 a Certificate for Quality Management System compliant with the international standards ISO 9001:2008.

Recommendations:

With regard for the lack of progress, as compared to the previous year, in terms of simplifying access of citizens to relevant information on the city budget, it is recommended that resolution of Ivano-Frankivsk city council on making amendments to the budget be copied in the section ‘City Budget’ on the official city website, or the city budget be posted showing all the changes over the current year.

Official website of Ivano-Frankivsk city council executive committee offers citizens a chance to get acquainted with the Statute of Local Community of the city of Ivano-Frankivsk. Resolutions by the City Mayor in an electronic database of regulatory acts are publicized on time, while the document search system in an electronic database allows searching for documents by different parameters: date, document title, words in the text, document view, etc. It simplifies it for citizens to access resolutions by the City Mayor and allows to quickly find the needed resolution.

In order to secure citizens’ right for access to public information, the official council executive committee has a section with details on the procedure to submit requests for information and the procedure to dispute actions of information administrators. The section contains generalized reports on processing requests for information, as well as samples of requests. Apart from that, there is a functioning Internet receiving office. With the help of the office citizens can submit requests for information and addresses online. The systems of filters and the interface of the Internet receiving office make it convenient to submit an electronic request. The function of ‘Processing Status’ allows tracking the stage your request for information or address are currently on.

Unfortunately, the same as last year, section on ‘Access to Public Information’ does not contain data on persons responsible for providing access to public information.

Recommendations:

To copy the resolution by the City Mayor ‘On Measures to Provide Access to Public Information’ and ‘On Introducing Changes to the Resolution by City Mayor of May, 26, 2011, #300-р ‘On Measures to Provide Access to Public Information’ in the section ‘Access to Public Information’ on the official website so that citizens could have exhaustive information both on the implementation mechanisms of the right for public information, and on units and officials responsible for securing the right.

Information on location, communication means numbers, email addresses, office hours of city council executive bodies is freely published on a website of executive committee of Ivano-Frankivsk city council. Citizens can also freely learn about the structure, personnel composition, powers, and functional duties of executive bodies. One can also have free access to information on all heads of executive bodies, deputy heads and chief experts (full names, office telephone numbers, email addresses), while there is no information on other officials of executive bodies. Photos and biographical data of executive bodies’ heads are not available, either.

As to access to information on organization of meetings of heads of executive bodies with citizens, there is free access via the executive committee website to the receiving hours of executive bodies’ heads and the procedure of applying for an appointment. The official website of executive committee of Ivano-Frankivsk city council offers free access for citizens to income declarations of deputy mayors. The official website also offers their biographical data, photos, and contact details. Receiving hours are also freely available on the website.

Apart from that, this year they have provided free access to declarations on property, revenues and financial liabilities of heads of executive bodies. Declarations on property and revenues of heads of executive bodies can be found in the section on ‘Access to Public Information’ at the official website of city executive committee. Last year, the access was only available to declarations of deputy mayors and executive administrator of executive committee.

Official website of the city of Ivano-Frankivsk also allows citizens to freely obtain information on companies, institutions, and organizations of social sphere (names of heads, contact details, field of activity) within the administration of the city council.

Recommendations:

Taking into account lack of progress in providing unimpeded access of citizens to photographs and bios of executive bodies’ heads, as well as information on full composition of executive bodies, we recommend this drawback deleted by publishing respective information on an official website of executive committee of Ivano-Frankivsk city council. Citizens must have free and unimpeded opportunity to get acquainted with the information on all persons responsible for the functioning of production and non-production spheres of municipal companies, as well as with more details on heads of executive bodies who bear direct responsibility for the economic areas they are competent in. Publicizing of biographical data on heads of executive bodies helps raising transparency levels and also allows citizens to give a basic assessment of an official and make some conclusions on relevance of their qualifications to the position they hold.

Citizens may find relevant information on time and place of Ivano-Frankivsk city council executive committee meetings on information stands on the premises of local authorities, and also from announcements on official website. Contact details and biographical data of an official (executive administrator of an executive committee) responsible for planning and organization of work of executive committee are freely available on the executive committee website.

Official website of executive committee of Ivano-Frankivsk city council provides free access to information on personnel composition of executive committee, information on educational background and workplaces of executive committee members. A photograph, biography and information on powers of executive committee and its members is not available at the official website. With no information on powers of executive committee and its members, citizens find it difficult to shape an opinion on decision-makers, as well as to figure out the functions this decision-making body is supposed to perform.

Access to information on executive committee is provided on due level. However, as compared to the previous year, there has not been any progress in providing access to larger amounts of information on the city council executive committee.

Recommendations:

Executive committee has an impact on the functioning of local self-government and the work of executive bodies. That is why exhaustive information on the powers of executive committee and its members has to be public and accessible so that citizens could easily find their way in functional duties and powers of this decision-making body, as well as to shape a basic assessment of persons who are part of this decision-making body. That is why we recommend to complement a section on executive committee on the official Ivano-Frankivsk website with information on the powers of executive committee, to provide citizens with free access to photos and biographical data on executive committee members by publicizing due information on the city official website.

Resolutions and Documentation of Executive Bodies?82%

Draft agenda of executive committee meetings, as well as draft resolutions, are published in advance. All resolutions adopted at the executive committee meeting are published in a well-structured and user-friendly electronic database of regulatory documents of local authorities. Electronic database of regulatory acts has been significantly increased as compared to the previous year. Now, citizens have access to resolutions adopted since 2008 (last year access was only available to resolutions since 2010).

The plan for preparing regulatory acts includes all necessary information (determining kinds and titles of draft acts, objectives for their adoption, deadlines of drawing the acts, names of bodies and units responsible for the development of draft regulatory acts) is publicized on the official website and in printed media. Announcements on publicizing the draft regulatory acts (that include information on the contents of the draft document, contact details of authors, ways of making the documents public, term and manner of considering remarks and suggestions) are publicized in the same way, while a regulatory act that has come into force can be found online in an electronic database of regulatory acts by the city council that are grouped in a separate tread there.

An annual plan for public procurement can be freely found at Ivano-Frankivsk official website. Information on services rendered by municipal utilities providers, as well as on their cost, can also be found on the website but the information is not complete as it only tells about housing utilities services for population of Ivano-Frankivsk. There is no free access to information on privileges for different categories of population and types of services they cover. The website only contains explanations on how to citizens may exercise their rights for privileges.

As compared to the previous year, certain progress has been recorded as to facilitation of access of citizens to programmes funded from local budget. Official website of Ivano-Frankivsk has been complemented with an additional section that includes acting local target-oriented programmes funded from the budget.

Recommendations:

To add and post in one section/tread/page of Ivano-Frankivsk website comprehensive information on services rendered by municipal utilities providers, as well as on their cost. Also, it shall include data on all municipal companies so that citizens could freely access information on full range and cost of services rendered by municipal companies of the city of Ivano-Frankivsk.

The city council has an established competent body of urban development cadastre within the structure of the Department of Urban Development and Architecture at the executive committee of Ivano-Frankivsk city council. Comprehensive information on land auctions, land plots to be sold via auctions, and results of land auctions is published on the official website of the Department of Land Relations of Ivano-Frankivsk city council.

As compared to the previous year, there has been progress on providing citizens with access to information on means and forms of communication with the deputies. The official city council website has a separate section that includes a mailing address to exchange letters with the deputies, an email, and a telephone number to connect with the deputies.

Place and hours to receive citizens by a deputy are posted on the official webpage of Ivano-Frankivsk city council. Biographical data on the deputies are available in their brief form and include the date of birth, educational background, work experience and the affiliated political forces the deputy was elected to the council.

You can have exhaustive information on the authorities of a deputy on the council website. The information is available in a separate section.

Recommendations:

In our opinion, community is entitled to have available all information about persons authorized to make decisions by a local self-government body. That is why we recommend a biographical note on deputies be more informative.

Structure and Work Organization of the Representative Body of Local Self-Government?82%

Regulations on work of the city council and the provisions on the work of deputy commissions are available on the city council website. Information on the composition of deputy commissions and the hours to receive citizens by the council secretary are available on the city council website. However, schedules of meetings of deputy commissions are only available on the information stands in the building of the city council. The Ivano-Frankivsk city council website does not have any structured information on the composition of deputy factions, either. As compared to the previous year, contact information with the council secretary has been made available on the council website. The official Ivano-Frankivsk website also offers citizens access to income declarations of the council secretary. Information on boundaries of majority constituencies where the city council deputies were elected is not freely and easily available.

The official Ivano-Frankivsk website has detailed information on duties and functions of the department on facilitation of deputy activities. It also has information on location, postal address, telephone numbers, and an email.

Recommendations:

In order to improve organization of work of a representative local self-government body and to more efficiently implement the principles of transparent policy into the work of Ivano-Frankivsk city council, we recommend to publicize on the city council website the following information:

  • schedules of meetings of deputy commissions;
  • composition of deputy factions;
  • information on boundaries of majority constituencies the deputies were elected from;
  • information on powers of the council secretary (to be posted in a separate section, similar to how information on powers of deputies is posted).

Information on the convening of the council session is published on time. Draft agenda and draft resolutions brought forward for the consideration at the session are also published on the website in advance.

Electronic voting system is not available. Therefore, information on the results of personal voting on each draft resolution is not available. Information on the registration of deputies at plenary meetings of the council sessions is not available, either. Online streaming of sessions is broadcast on the council website but the recordings of sessions are not available.

Recommendations:

To introduce an electronic voting system that would help raise personal responsibility of a deputy for the decisions made by the council as it would allow citizens assess personal contributions of every deputy. Information on registration of deputies at the council plenary sessions shall be publicized on the official website of the council (no later than the next day following the session) so that citizens could have a chance to immediately track the attendance of deputies at the sessions.

In order to provide uninterrupted access of citizens to video recordings of city council sessions, it is recommended that all video recordings be posted on the council website. Citizens who had not had a chance to follow the session online would be able to view the recording. In case there are no technical facilities to post video recordings of sessions on the council website, conditions shall be provided to help citizens obtain video recordings of sessions on the digital information carriers.

Regulatory Legal Acts and Other Documents by the City Council?61%

All resolutions of the city council are publicized in a convenient and well-structured electronic database of regulatory acts of Ivano-Frankivsk city council. The practice of publicizing minutes of city council sessions and meetings of deputy commissions has been launched but the work lacks regularity. Also, not all minutes are published on the council website. The contents of deputy requests are not published on the council website, either.

Resolution to regulate the scope of deputy funds for the fulfillment of their duties and the procedure of use of resources from the deputy fund is available in free access in the electronic database of regulatory acts of Ivano-Frankivsk city council. The plan of fulfillment of mandate of voters by the deputies is not available.

Recommendations:

To publish all deputy requests so that citizens could assess the initiative of a deputy and the priorities of his deputy activities.

To publish on the official website the plan of implementation of coters’ mandate by the city council deputies.

In order for citizens to be able to follow the work of the deputy corps when they are not able to attend the sessions of the council or the deputy commissions, it is recommended that minutes of all sessions of the city council and the deputy commissions be posted on the official website of the council.

According to the schedule of receiving hours, the City Mayor only spends less than 8 hours a month to receive citizens. Application for a visit starts in advance (10-15 days before the day of the visit). Executive committee informs on it in a special section on the website. Also, as compared to the previous year, there has been an advance as city executive committee provided citizens with the access to the procedure of applying for a visit through the website. Provisions on the arrangement of verbal meetings in Ivano-Frankivsk city council executive committee on personal issues is posted on official website in a separate section, while the notice on the start of application processes to meet the mayor also contains information on conditions citizens have to meet to get an appointment. During the application process citizens must provide a summary of the issue for discussion, the results of preliminary consideration of the problem (if a citizen had had any previous appointments), submit documents and other materials to substantiate their request, and fill in the special form for personal appointments. Remote application for appointments, via an online form, for example, or by telephone is not used on the official website. Access to a building where the mayor meets citizens is also available for persons with disabilities as the ground floor has a ramp and a call button. Field meetings are also held by the mayor once every three months. In addition to that, the executive committee has an urgent telephone response unit 15-88 which runs round the clock. Every Tuesday they run ‘hot telephone lines’ of the executive committee structural units.

According to the information provided in response to the request we submitted, the City Mayor holds consultations with the public. He initiated 29 public hearings. There is also a range of advisory and consultancy bodies under the auspices of the City Mayor, as well as working groups.

As compared to the last year analysis where the City Mayor had not initiated any of the public hearings held, this year there has been some progress in initiating consultations with the public through public hearings.

The website does not have any information which would be accessible to citizens in a convenient form to tell about the procedure of submitting requests. Instead, there is an opportunity of remote (electronic) requests with detailed description on the implementation of this opportunity.

 

Recommendations:

Taking into account the fact that in comparison with the previous year there has not been any progress as to providing citizens with the chance to apply for an appointment remotely and provide free access to information on the procedure of citizens’ requests, we therefore recommend the following:

To introduce a system of electronic applications for appointments so that citizens could have an opportunity to apply for an appointment with the City Mayor remotely in most convenient time for them;

To add to the official website information on the procedure of citizens’ requests and the procedure of processing requests so that citizens could have access to exhaustive information on the forms of requests and the terms of their processing.

Meetings of Ivano-Frankivsk city council executive committee can be freely attended by citizens after formal registration right before the meeting. They also have free access to the premises of the city council (offices of departments, units, etc.).

Citizens can get acquainted with the procedure of implementing mechanisms of public participation by reading the Statute of Local Community of Ivano-Frankivsk which is published on official website. Announcements on public hearings and minutes of public hearings are published on the official city website. Executive bodies also have a number of established advisory and consultancy bodies.

The official Ivano-Frankivsk website has a valid information section on ‘Access to Public Information’ which contains all necessary information such as procedures to prepare and submit a request for information, request forms, procedure to dispute resolutions (actions or inactivity) of information executives, reports on processing information requests, etc. citizens can also submit a request for information in an electronic form, through a system of an Internet receiving office of Ivano-Frankivsk city council after filling in the respective form on the website.

Executive bodies meet the deadlines set by the law as to processing requests for information. It is hardly feasible to make any specific conclusions on the contents and completeness of responses to requests. The section of citizens requests offers citizens an opportunity to work with regulatory documents of the city council (place for work with documents is fitted with desks, chairs, and a telephone). Pay for copying and printing of responses to requests that include over 10 pages does not exceed limits set by the law, or the 0.1 % of the minimum salary rate. In the lobby of an administrative building, there is also an electronic information box where citizens can find all necessary regulatory documents of the city council, executive committee and the City Mayor.

Center for Rendering Administrative Services (CRAS) helps have convenient access to administrative services and raises quality of rendering administrative services. There are clear and understandable rules to obtain all available administrative services in one building. There are free of charge reference materials available at CRAS that describe the administrative services. There are also information stands equipped to show samples of relevant documents and information that explains how to obtain an administrative service without anyone’s assistance. There are forms to be filled in (samples) to apply for an administrative service. Experts in rendering administrative services, heads of field-specific departments, units and sections that render administrative services have open visiting hours for citizens. CRAS also has a possibility of an electronic waiting line. The website of the Center for Rendering Administrative Services allows you to apply for an electronic waiting line online and also track the processing status of an administrative service.

The CRAS website has exhaustive information on all services rendered by executive bodies, terms and conditions to obtain such services, as well as forms to fill in to apply for an administrative service. It allows a citizen to come to CRAS to obtain a service with the ready-made set of documents. Therefore, time to get an administrative service is reduced.

Citizens have the right of free access to the city council sessions. The regulations of the city council published on the council website provides for unimpeded access of citizens to the meetings of deputy commissions. A formal procedure of written registration can be followed right before the session of the deputy commission. Information on the number of public hearings initiated by the deputies is not available. More than half of city council deputies hold personal meetings with the voters at a set time and allocated place.

The procedure for public hearings and local initiatives is stipulated by the Statute of Local Community. The procedure for establishing a public council is stipulated in the Provisions on Public Council at Ivano-Frankivsk city council adopted by the council session.

According to official information provided in response to a request, during 2014 the City Mayor only informed the public at an open meeting on the status of social economic and cultural development of Ivano-Frankivsk once (on May, 18). However, we cannot treat this meeting with the community as public reporting of the City Mayor to the community since it was announced in mass media as a meeting with the candidate for people’s deputy of Ukraine (interim election of deputies of the Supreme Council of Ukraine on May, 25, 2014 in a one-mandate constituency #83).

The City Mayor has not reported to the community on implementation of national regulatory policy. We also failed to find in any open sources any text on the implementation of national regulatory policy.

As to reporting procedure, there has not been any progress, as compared to the previous year. There is no document to clearly regulate the reporting procedure. The Statute of Local Community of Ivano-Frankivsk only provides for the duty of the City Mayor to report to the public. It does not stipulate any forms or time frames for the reporting. The fact that the reporting procedure of the City Mayor to local community is not clearly regulated allows an official to freely choose any form of reporting to community. It does not always favour free discussion of the City Mayor with the community on the contents of reports.

As compared to the previous year, there has been noted certain regress in the issue of accountability of the City Mayor. The city head has not reported to the council. The meeting with community on May, 18, 2014, cannot be treated as a public report of the City Mayor since this event was declared as a meeting with the candidate for people’s deputy, not as a report of the city head to the community. The text of report of the City Mayor was not possible to find in open sources. Texts of reports of executive bodies are publicized on official website of Ivano-Frankivsk city council executive committee.

Recommendations:

To initiate changes to the Statute of Local Community of the city of Ivano-Frankivsk that would provide clearly defined procedures and forms of reporting of the City Mayor to the local community at an open meeting.

Reporting of a City Mayor to local community shall be held at an open meeting with mandatory informing of citizens on time and place of the meeting via an official city website and mass media. This way, citizens would be able to obtain first hand information on performance results of the City Mayor and also have an opportunity for public discussions on the contents of the report and the performance results.

To follow the requirements set in par. 17, part 6, Article 55 of the Law of Ukraine ‘On Local Self-Government’ and to report to the community at least once a year on the performance, and on the implementation of the Law of Ukraine ‘On Access to Public Information’ and implementation of national regulatory policy. The text of report shall be publicized on official website of executive committee.

The official website of Ivano-Frankivsk also offers an opportunity to get acquainted with reports on executive bodies’ performance. Executive bodies do not report directly to the community. Report on implementing a programme of economic and social development of the city is published on the website but, the same as last year, there is no sufficient public information on the implementation of local target-oriented programmes.

As to written reporting of executive bodies to the city council on the course and results of municipal property alienation, there has been certain regress. Last year, the practice was available and you could find this information on the official website. As to this year, a response to the request informed that a Fund of municipal property responsible for municipal property alienation does not prepare such reports for the city council since it is not stipulated by any regulatory acts.

Reports as to consideration of requests for public information are regularly published on the website of executive committee in the specific section to a topic.

Recommendations:

To introduce the practice of direct reporting of executive bodies to the community at a public meeting. Thus way, citizens would have an opportunity to ask direct public questions on the work of executive bodies and the contents of their reports. It would enhance liability of executive bodies before the community and allow having public discussions as to efficiency of executive bodies performance.

To publish final reports as to implementation of target-oriented programmes, as well as interim reports on the course of implementation of target-oriented programmes in the current year so that comprehensive information on the course of local programmes were available to citizens.

To introduce a practice of regular updating citizens on the course and results of municipal property alienation via the official website of Ivano-Frankivsk city council executive committee.

The financial information published on the official Ivano-Frankivsk website is enough to understand the structure and scope of expenditures of local budget, especially as to how much financial resource is spent to support the functioning of a local self-government body, executive bodies in particular.

As compared to the previous year, there has not been any progress in deputies reporting on their performance. There is not available report on the work of permanent deputy commissions. The practice of deputy commissions reporting to the council is not used. The procedure of reporting to the voters is not regulated either by the Statute of Local Community or any other separate document. Information on the terms for deputies reporting to the voters or reporting schedules are not available in free access, either. The official website only has texts of reports by less than half of city council deputies. Also, less than half of deputies submitted information to executive bodies on reporting results and informed on the fulfillment of voters’ mandate.

Apart from that, as compared to the previous year, there has been some deterioration in providing citizens with access to information on the use of budget funds from the City Council Fund for the fulfillment of deputy mandate.

Recommendations:

So that voters could have sufficient information to assess the performance of the deputy corps, it is recommended that deputies use the practice of reporting to the voters, publish texts of reports on the council website (so that they were always accessible), start the practice of deputy commissions reporting on their work.

It is also recommended to publish on the council website information on time and place of a deputy reporting to the voters, on reporting results, remarks and suggestions of citizens by the results of reporting, information on the deputy fulfillment of voters’ mandate, so that voters could have free access to sufficient information to be able to assess the work Ivano-Frankivsk city council deputy corps.

Also, taking into account that deputy reporting to the voters is not clearly regulated by the laws, it is recommended that a strictly defined procedure be introduced for deputies reporting to the voters to have unified standards and avoid free interpretation of the forms of reports, time frames for reports, and forms of publicizing the texts of reports.

Moreover, in order for citizens to have an opportunity to follow the use of resources of the City Council Fund for the fulfillment of deputy mandate, it is recommended that the practice of publishing reports on expenditures of budget money from the ‘deputy fund’’ be reintroduced.
